La pop-star américaine Madonna va faire appel de la décision d'un tribunal du Malawi de lui refuser l'adoption d'un deuxième enfant dans ce pays, une petite fille orpheline de 3 ans, a annoncé vendredi son avocat.

"J'ai lancé une procédure d'appel", a déclaré à l'avocat de Madonna, Alan Chinula.

Un tribunal de Lilongwe a rejeté vendredi matin la demande d'adoption déposée en début de semaine par Madonna.

La chanteuse avait déjà adopté un premier enfant, un petit garçon, dans ce pays pauvre d'Afrique australe, suscitant une polémique sur le passe-droit dont elle aurait bénéficié grâce à sa célébrité.

Madonna a décidé de faire appel vendredi après-midi, après avoir été informé du résultat négatif de sa demande d'adoption, a expliqué son avocat.

La procédure d'appel devrait débuter la semaine prochaine, selon lui.

Madonna doit quitter le Malawi dimanche.

Vendredi matin, la juge du tribunal de Lilongwe avait motivé son refus d'accorder l'adoption souhaitée par Madonna en expliquant que la fillette, Chifundo James, ne vivait "plus dans la pauvreté depuis son admission à l'orphelinat de Kondanani" (sud).

La juge a également motivé sa décision par le risque de favoriser le trafic d'enfants si la justice ouvrait, avec ce précédent, la porte aux adoptions internationales sans respecter la procédure.

Madonna, qui était absente à l'audience, et son avocat, qui a évité la presse, n'ont pas commenté la décision de justice.

Sa demande d'une seconde adoption avait, comme pour le petit David, provoqué la colère des ONG locales et internationales.

Pour adopter un mineur, les lois du Malawi sont très strictes et les étrangers doivent être résidents depuis au moins 18 mois.

Seule Madonna a fait exception à cette règle en adoptant un petit garçon, David Banda, rencontré en 2006 lors de sa première visite au Malawi. Elle avait alors été accusée par de nombreuses associations de s'être servie de sa célébrité et de sa richesse pour accélérer la procédure.

La chanteuse américaine, déjà mère de deux enfants, avait en effet obtenu immédiatement la garde de l'enfant pour 18 mois et avait quitté le pays avec lui. En mai 2008, elle avait pu l'adopter de plein droit avec l'accord du père biologique.

Près de 500 000 euros a payé

Le jeudi 12 mars, Reservoir Prod, société de production dont Jean-Luc Delarue est le président a été condamnée par le conseil des Prud'hommes, révèle le Nouvel Obs. On lui reproche le licenciement "sans cause sérieuse" de Maria Roche, ancienne directrice de la rédaction de "Jour après jour". 

Un licenciement "abusif, injurieux et vexatoire"

En 2006, le présentateur l'avait licenciée sans préavis ni indemnités "pour fautes graves". Les prud'hommes ne l'ont pas vu ainsi. Le juge a estimé qu'elle n'avait commis aucune faute grave et qu'il n'y avait pas de cause sérieuse de licenciement. Selon l'explication donnée par l'avocat de Maria Roche, le juge l'aurait même estimé "abusif, injurieux et vexatoire".

Dans le Nouvel Obs, l'avocat égrène ce que Reservoir Prod devra payer à sa cliente : " le préavis de 54.900 euros, ainsi que les congés payés (5.490 euros) et les indemnités conventionnelles de licenciement s'élevant à 12.810 euros". 

Ce n'est pas tout car le conseil estime qu'il n'y a pas de cause sérieuse de licenciement. Du coup, l'avocat de Maria Roche explique que la boite de production devra "verser 183.000 euros à ma cliente à titre de dommages et intérêts. Le Conseil alloue en outre 40.000 euros à Mme Roche au titre que le licenciement est abusif, injurieux et vexatoire”, 

A l'arrivée, Reservoir Prod devra débourser au moins 493.200 euros, selon le Nouvel Obs.

Un porte-parole du RSPCA (SPA russe) a déclaré : "Nous sommes contre l'utilisation d'animaux pour ces modifications purement esthétiques et qui dépendent seulement du bon vouloir du propriétaire."

" Nous ne croyons pas à l'utilisation d'animaux comme des accessoires de mode ajoute t'il, cela démontre le manque de respect que l'homme porte à l'animal quel qu'il soit.  Et de conclure " Nous espérons simplement que cette pratique abominable ne se propage pas".
